Online Shop and Tickets
GENERAL TERMS AND CONDITIONS OF TICKET SALE PURSUANT TO Art. 1341 et seq. of the Italian Civil Code
§1 General Provision
These General Contract Conditions (hereinafter referred to as "GTC") apply to all contracts between the customer and Jazzopen Italia (hereinafter referred to as "Jazzopen") regarding concert attendance. Such contracts are considered implicitly concluded upon the purchase of tickets for events promoted by Jazzopen Italia S.r.l. through any sales channel.
By placing a ticket order, the customer authorizes Jazzopen Italia S.r.l., as an authorized commercial agent, to process the ticket purchase, including its delivery.
Consumers, for the purposes of these GTC, are natural persons who enter into a legal transaction for purposes that are predominantly unrelated to their commercial or independent professional activity.
Entrepreneurs are natural or legal persons or partnerships with legal capacity who, at the time of entering into a contract, act in the course of their commercial or independent professional activity.
For the purposes of these GTC, "Customer" refers to both consumers and entrepreneurs purchasing tickets.
Any contractual terms proposed by the customer that are divergent, conflicting, or supplementary do not become part of the contract unless their validity has been expressly agreed upon in writing.

§2 Conclusion of the Contract and Payment Methods
Jazzopen reserves the right to modify ticket offers on its sales channels at any time.
By placing an order, the customer makes a binding offer to conclude a contract. Receipt of the order will be immediately confirmed; however, this confirmation does not yet constitute acceptance. Acceptance may be explicitly declared or combined with the shipping confirmation, and until that point, Jazzopen may revoke its consent to dispatch.
Jazzopen reserves the right to refuse orders at its sole discretion. Jazzopen also reserves the right to determine, on a case-by-case basis, the number of tickets that can be ordered per household.
The conclusion of the contract is subject to the actual availability of tickets. In case of unavailability or partial availability, the customer will be informed immediately. Payments already made will be refunded.
Actual prices may exceed the printed ticket price. The total price, including fees, is due at the time of contract conclusion as indicated in the order confirmation.
Orders placed via the Internet or call center may incur service and shipping costs, which will be transparently communicated in the shopping cart or by phone. No other undisclosed costs apply.
§2 Voucher Use
After purchasing a voucher through Jazzopen’s online ticketing system or at affiliated agencies, the customer will receive a file containing a voucher code.
Vouchers can only be redeemed by the actual beneficiary.
Only one voucher can be used per order.
A new voucher code will be issued for any remaining amounts.
Subsequent crediting is not possible.
Transfer of the voucher to third parties is permitted; in this case, the original purchaser cannot reuse or redistribute the code.

§3 Retention of Title
In the case of consumers, Jazzopen retains ownership of the goods until full payment of the purchase price.
In the case of entrepreneurs, the goods remain the property of Jazzopen until full payment of all receivables arising from the ongoing business relationship.
The customer must inform Jazzopen immediately if third parties access the goods (e.g., seizure), as well as in cases of damage, destruction, or change of residence.
In case of breach of contract, particularly non-payment, Jazzopen reserves the right to withdraw from the contract and reclaim the goods.

§4 Resale of Tickets
Commercial resale of tickets is prohibited.
Private resale is permitted only at the original price plus verifiable expenses (e.g., shipping).
In case of violation, the organizer may deny entry to the event for the ticket purchaser.

§5 Right of Withdrawal – Exclusion
There is no right of withdrawal for ticket purchases.
Pursuant to Legislative Decree 206/2005, there is no right of reflection or withdrawal for consumers, as purchased tickets relate to “services connected to leisure activities, where the contract specifies a specific date or period of performance.” Therefore, in general, tickets for concerts, shows, theater, sports events, etc., cannot be returned.

§6 Liability
Jazzopen Italia S.r.l. assumes no liability toward entrepreneurs for minor breaches of contract.
Limitations of liability do not apply to claims arising from product liability or damages to life, physical integrity, or health caused by a breach or default by Jazzopen Italia S.r.l.
Jazzopen Italia S.r.l. assumes no responsibility for content on third-party websites that may be linked and undertakes to remove illegal links without delay.
The customer expressly releases Jazzopen Italia from any liability resulting from negligent violation of the law.

§7 Data Protection
The customer has been informed of the type, extent, and purpose of the personal data processing carried out by Jazzopen pursuant to EU Regulation 679/2016 and subsequent amendments.

§8 Final Provisions
The applicable law is Italian law.
Should any provision of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the corresponding provision of the Italian Civil Code and related special laws.

1. Scope of Application
These General Contract Conditions (hereinafter "GTC") apply to all visitor-concert contracts concluded between the customer and Jazzopen Italia (hereinafter "Jazzopen"), which are considered implicitly concluded upon purchase of tickets for events promoted by Jazzopen Italia S.r.l. through any sales channel.

2. Ticket Purchase
2.1 Tickets may only be purchased at the Jazz Open Ticket Shop at www.jazzopen-modena.com, via Vivaticket, or through any distributor authorized by Jazzopen Italia S.r.l., headquartered in Modena (MO), Via Farini 27, VAT no. 04207120363.
2.2 The General Contract Conditions of Jazzopen Italia S.r.l. apply exclusively to the processing of ticket purchases across all sales channels provided by the company.

3. Authorization to Access the Event
• Children under 3 years old are not allowed to enter the event venue.
• Minors aged 3–17 may attend concerts only if accompanied by a person with parental authority.
• Minors aged 3–6 may enter for free without a seat, accompanied by a parent or legal guardian.

4. Security Checks
Upon entering the event venue, security personnel will conduct checks for public safety to prevent risks to the visitor or other attendees. Jazzopen Italia S.r.l. reserves the right to deny entry if the visitor carries prohibited items, such as professional cameras and/or video cameras, cans or bottles, umbrellas, weapons, knives of any kind, fireworks, or other items deemed inappropriate at the organizer’s sole discretion.

5. Exclusion of Visitors
5.1 For serious reasons, particularly if a visitor commits an offense or endangers others, Jazzopen Italia S.r.l. has the right to exclude the visitor from the event at any time.
5.2 In any case, if Jazzopen Italia S.r.l. exercises this right, the ticket becomes invalid. There is no right of re-entry or refund.

6. Prohibition and Authorization of Image and Sound Recordings
6.1 Only 35mm cameras and mobile phones with camera functions are allowed in the event area. Recordings may be made for personal use only. Use beyond personal purposes is prohibited.
6.2 Unauthorized use of images is considered public and is prohibited unless specifically authorized.
6.3 Bringing DSLRs, cameras with zoom lenses or video functions, video cameras, or any audio recording devices (e.g., tape recorders, MP3 recorders) or other means to record the event without authorization is prohibited.
6.4 Jazzopen Italia S.r.l. may refuse entry to the event site unless the visitor agrees to leave prohibited equipment behind.

7. Resale of Tickets
Commercial resale of tickets is not allowed. For private resale, tickets may not be sold above the original printed price plus any verifiable fees charged at the time of purchase.

8. Unilateral Changes to the Program
8.1 Jazzopen Italia S.r.l. reserves the right to modify the event program and pre-program at any time at its discretion.
8.2 If a supporting band cancels due to illness and Jazzopen Italia S.r.l. is not responsible, the company will attempt to provide an appropriate substitute and may modify the program at the opening of the main concert. Visitors have no right to a refund due to cancellation of supporting acts.

9. Force Majeure and Extraordinary Events
9.1 The concert may take place in any weather. If conditions prevent the event from proceeding, it may be canceled or interrupted.
9.2 If the concert cannot take place due to force majeure, particularly danger to life or physical safety due to weather conditions (e.g., heavy rain, hurricane, hail), the concert must be canceled or interrupted.

10. Instructions and Information
Visitors must follow the instructions of security personnel. Up-to-date information is available daily on the festival website www.jazzopen-modena.com and the social media page www.facebook.com/JazzOpenModena.

11. Event Interruption Due to Terrorism
If the event is canceled in whole or in part by event security or authorities (e.g., due to force majeure) because of a bomb threat, terrorist attack, or imminent threat thereof, the event is canceled without liability of the organizer, and there is no right to refund tickets or incurred costs.

12. Liability
Jazzopen Italia S.r.l. excludes contractual and legal liability for damages of any kind. This exclusion does not apply to damages caused intentionally or by gross negligence, to simple negligence resulting in injury to visitors’ physical integrity or health, or to material breach of essential contractual obligations by Jazzopen Italia S.r.l.

Alternative Dispute Resolution for Consumers
1. If the purchaser is a consumer and bought the ticket online, the organizer informs that the European Commission provides an online dispute resolution platform: www.ec.europa.eu/consumers/odr.
2. If the visitor did not purchase the ticket online, the organizer does not participate in any dispute resolution procedures.
3. A consumer is any natural person who purchases a ticket for purposes unrelated to their commercial or independent professional activity, as defined by Legislative Decree 206/2005 (Italian Consumer Code).

Consent for Recording and Use
• Visitors consent to photographic and audio recordings of themselves.
• Consent extends beyond Italian Civil Code copyright provisions.
• Jazzopen Italia S.r.l. or third parties acting on its behalf may take photographs of visitors in public areas during the event and use them indefinitely for advertising purposes across usual online and print media, including social media channels, the Jazz Open website, flyers, program booklets, and press coverage, without compensation to the visitor.

INTERNAL REGULATIONS FOR THE MODENA EVENT

§1 Scope
These regulations apply to the entire Jazz Open festival area and associated areas.

§2 Purpose
The purpose of these internal rules is to prevent dangers or harm to persons, ensure the smooth running of events, and protect the festival area from damage or contamination.

§3 Alcohol and Beverage Restrictions
Persons under the influence of alcohol may be excluded from attending the events.
For safety reasons, beverages (non-alcoholic only) are allowed in containers up to 0.5 liters per person in Tetra Pak packaging. Larger containers (over 0.5 L), bulky items, glass, PET bottles, and cans are prohibited.

§4 Prohibited Conduct
Visitors are not allowed to:
1. Enter the site without a valid ticket or other authorization, which can only be granted by the organizer or site management. Violations will be prosecuted.
2. For assigned-seat tickets, occupy a seat other than the one assigned.
3. Block corridors or stairs leading to assigned seats.
4. Stand on chairs or benches.
5. Access areas and rooms not expressly intended for the public.
6. Move within the area in vehicles of any type without special permission from Jazz Open, or park in unauthorized areas.
7. Remove or climb over any containment structures.
8. Bring dangerous or bulky items, or objects suitable as projectiles, including glass bottles, PET bottles, Tetra Paks over 0.5 L, cans, weapons, umbrellas, flagpoles, blankets, or pressurized gas cylinders.
9. Transport, ignite, or use fireworks, smoke bombs, streamers, or pyrotechnic devices of any kind, or light fires.
10. Bring backpacks larger than 30 x 30 cm, handbags (except for women’s bags up to 30 x 30 cm), strollers, bulky picnic baskets, large coolers, ladders, portable seating, boxes, or similar objects.
11. Throw objects onto the stage, into the auditorium, or any area.
12. Use the area’s grounds or facilities as toilets, litter, or bring confetti, paper scraps, or rolls of paper.
13. Bring animals into the area.
14. Damage or deface walls or surfaces within the event area.
15. Consume cannabis or other drugs within the festival area.
16. Make film, video, or audio recordings without the organizer’s permission. Visitors may use smartphones or pocket cameras to take personal photos. Cameras with interchangeable lenses are generally prohibited without explicit authorization. Press photography is allowed only for authorized media.
Enforcement: In case of violation, Jazzopen Italia S.r.l. reserves the right to exclude visitors from the event. Tickets become invalid, with no right to re-entry or refund.

§5 Compliance with Security
Visitors must follow instructions from security personnel. Violations of these internal rules may result in expulsion from Jazz Open, without ticket compensation, and/or exclusion from the premises, with authorities contacted if necessary. Security personnel have the right to enforce access restrictions on behalf of the organizer. Legal provisions, especially regarding public and worker safety, cannot be overridden.

§6 Age Restrictions
Children under 3 years old may not access the event venue. Minors aged 3–17 may attend concerts only if accompanied by a parent or legal guardian. Children aged 3–6 may enter free of charge without a seat, accompanied by a parent or legal guardian.

§7 Applicable Law
For all matters not expressly covered, Italian civil and criminal law applies, which is considered the sole applicable law.
